The deal between you and us. Short, and in plain words, because terms nobody reads protect nobody.
Divergence Holdings Pty Ltd (ABN 14 670 554 748), trading as Small Biz Systems. “Cashboard” means the service at cashboard.smallbizsystems.com.au. By using it you accept these terms; if you do not accept them, do not use it.
Cashboard categorises what you upload and projects it forward using your own history. Every figure it shows, including profit, GST, break-even and any projection, is a calculation over the data you gave it. It is a tool for understanding your numbers, not advice about them.
It is not a substitute for an accountant, bookkeeper, BAS agent or financial adviser, and it is not a lodgement tool. Before you rely on anything here for a tax return, a BAS, a loan application, a quote or any other decision, check it against your source records and take professional advice.
Statement parsing, including the AI-assisted reading described in Privacy, can misread a row. Rules you write apply to future uploads automatically. Duplicate detection can miss a pair, or flag one that is genuine. Review what lands in your books; it stays your responsibility.
You keep ownership of everything you put in. We claim no rights over it beyond what is needed to run the service for you. You can export it or delete it at any time from Settings, and we will not hold it hostage.
Cashboard is a small product run by a small operation. We do not offer a guaranteed uptime, and there will be occasions when it is down for maintenance or because a provider we depend on is having a bad day. We will give reasonable notice of planned interruptions where we can.
Keeping your own export is a sensible habit, and takes one click.
What you pay, how often, and when it starts is whatever we have agreed with you in writing. Some accounts are free; where a fee applies, these terms cover how it is collected.
You can close your account whenever you like, from Settings. We may suspend or close an account that breaches these terms, or if we stop offering the service, in which case we will give you reasonable notice and a chance to export first.
Nothing here excludes rights you have under the Australian Consumer Law, including the consumer guarantees, and if we are entitled to limit our liability for a breach of those guarantees, we limit it to resupplying the service or paying to have it resupplied.
Otherwise, and to the extent the law allows: Cashboard is provided as is; we are not liable for indirect or consequential loss, or for loss of profits, revenue or data; and our total liability for any claim is capped at the greater of the fees you paid us in the preceding twelve months, or one hundred dollars.
If we change these terms materially we will ask you to accept the new version when you next sign in. Minor corrections may be made without asking.
These terms are governed by the law of Queensland, Australia, and you and we submit to the courts of that place.
